Terms and Conditions

Session Policies

It is understood that Rokit Photography( hereby referred to as "Photographer") is the exclusive official Photographer retained to perform the photographic service requested on the contract. No other cameras, video cameras, or cell phone pictures are permitted during the session. The photographer is not responsible if the client(s) or other individuals fail to appear or cooperate during photography sessions. If the client and/or other individuals fail to appear, the session fee is non-refundable. While I do my best to work with unforeseen circumstances, no refund or reshoot will be provided solely due to uncooperative participants. Session starts at the agreed time. It is strongly encouraged that client(s) arrive at least 15 minutes prior. If the client is more than 25 minutes late, the session will be rescheduled at the photographer's discretion. In the unlikely event, the client is completely dissatisfied with the final results based solely on personal preference the Photographer will not reshoot. In the event of camera or storage failure, the Photographer will reshoot at no charge. No refund will be issued for any technical failures. It is also understood that the client is hiring the Photographer for his/her technical and artistic expertise and, therefore, the Photographer reserves the right to edit the images as he/she sees fit.

Rescheduling & Cancellations

At the time the contract takes effect, the photographer shall reserve the date and time agreed upon. For this reason, in the event the client cancels the contract for any reason, whether it be rescheduling, canceling, or fail to appear without a 48-hour notice, all other monies collected will be retained by the Photographer in order to offset the loss of business. Any reschedules will be based on the Photographer's availability. Rescheduling will not be given for poor choice of clothing or not following the recommendations of the Photographer.

Archive

After (12) twelve months, all images will be purged from photographer's hard-drive, except as needed for promotional purposes, to be determined by photographer at photographer's sole discretion. The photographer is not responsible for loss or damage to the digital files due to circumstances beyond the Photographer's control.

Proofs

Rokit Photography has sole discretion in selecting the images to show you from your session and is under no obligation to show more. Unretouched proofs are never presented or sold to clients.

Damage

The photographer is not responsible for the damage of products after delivery to the client, including damage caused during transit by U.S. Postal. Client assumes all responsibility for the safety of all products upon receipt.

Delivery & Process of Images

Final products will be processed and delivered to the client(s) within 4 to 12 weeks of the session date in the form of the requested products.

Liability

Rokit Photography is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for themselves and release photographer from any claims against their person or their business. Rokit Photography will not be liable in the unlikely event that a problem arises, whether due to accident, loss of materials, acts of God, equipment or other failures not caused by Photographer. The photographer is not responsible for the loss of, or interference with, the photography or images including but not limited to, restrictions of the location, interference from surrounding devices, access limitations, flash restrictions, equipment malfunctions and other similar in the likeness. This limitation on liability shall also apply in the event that photographic materials or images are damaged, lost through camera malfunction, lost in the mail, lost or damaged without fault on part of the Photographer.

Indemnity

Client agrees to indemnity and holds harmless Rokit Photography against any claims, lawsuits, judgments, court costs, damages and other expenses, including attorneys' fees, arising from or related to client's use of the images or Photographer's performance of this agreement.

Copyright & Penalty

Rokit Photography retains all copyrights to all images created during the client's session. A "Print release" can be purchased with each digital file to print for personal use up to a designated size list on the release. The print release does not allow publication of your artwork, commercial use, selling or altering of your artwork without Rokit Photography's written permission. It is a violation of the Federal Copyright Law and illegal to copy, scan, download, print, share, alter, or otherwise steal any artwork created by Rokit Photography. This applies to images posted in an online proofing gallery, Facebook, blog, Instagram, Twitter, Tumblr, or hard copy images. Taking screenshots is also illegal. If client steals images via any methods listed above, or any other method, the client will be invoiced for the cost of EACH digital image client has stolen, at $100 per image. * Exception: the client may use watermarked images provided by the Photographer only if permission is granted to do so.*

Final words from Rokit Photography I work extremely hard to create masterpieces that reflect you while keeping in-line with my own awesome artistic vision and creativity. I know you will want to share your artwork, I simply ask that you link it back to my website/Facebook/Instagram page instead of the right-click save image method and sharing the artwork via your own page. I also ask that you only post artwork with my watermark on them and give credit to Rokit Photography. I hope that you respect, not only my hard work, but the time, money, equipment, training, and dedication I have put into creating your artwork for you. Please do not steal them.
