Terms and Conditions for Rokit Photography
Rokit Photography (hereafter referred to as “the Photographer”) is the exclusive photographer retained for the contracted session. No other cameras, video equipment, or cell phone photography are permitted during the session.
The Photographer is not responsible if the client(s) or other individuals fail to appear or cooperate during the session. If client(s) fail to appear, the session fee is non-refundable. While I will always do my best to work with unforeseen circumstances, no refunds or complimentary re-shoots will be provided solely due to uncooperative participants.
Sessions begin at the agreed-upon time. Clients receiving hair and makeup are encouraged to arrive 15 minutes early. If the client arrives more than 15 minutes late, the session may be shortened or rescheduled at the Photographer’s discretion. No refunds will be given for lost time.
In the unlikely event the client is completely dissatisfied with the final results based solely on personal preference, the Photographer will not provide a re-shoot. In the event of equipment failure or data loss, the Photographer will re-shoot at no additional charge. No refunds will be issued for technical failures. Clients understand that they are hiring the Photographer for both technical skill and artistic vision; therefore, final editing decisions are made at the Photographer’s discretion.
Rescheduling & Cancellations
Once the contract takes effect, the Photographer reserves the agreed date and time exclusively for the client. In the event of cancellation, rescheduling, or failure to appear without at least 48 hours’ notice, all monies paid will be retained by the Photographer to offset lost business.
Any reschedules are subject to the Photographer’s availability. Rescheduling will not be permitted for poor clothing choices, failure to follow recommendations, or lack of preparation by the client.
Archive
Images are stored for 12 months from the session date. After that time, files may be purged from the Photographer’s hard drives. Select images may be retained indefinitely for promotional use, at the Photographer’s sole discretion. The Photographer is not responsible for loss or damage to files after delivery or due to circumstances beyond their control.
Proofs
The Photographer has sole discretion in selecting which images are presented for proofing. Unedited proofs are not for sale and will never be provided to the client.
Damage
The Photographer is not responsible for damage to products once they have been delivered to the client, including damage caused in transit by the postal service. Clients assume responsibility for the safety of all products upon receipt.
Delivery & Processing of Images
Final products will be processed and delivered within 4–6 weeks of the session date. For larger projects, delivery may take up to 8 weeks, depending on complexity.
Liability
The Photographer is not responsible for injuries sustained by clients or participants during the session. Clients are solely responsible for themselves and release the Photographer from any related claims.
The Photographer will not be liable for circumstances beyond their control, including but not limited to: location restrictions, equipment malfunctions, acts of God, interference from external devices, or mailing issues. This limitation on liability also applies if photographic materials are damaged or lost without fault on the Photographer’s part.
Indemnity
The client agrees to indemnify and hold harmless Rokit Photography against any claims, lawsuits, judgments, court costs, damages, or expenses (including attorney’s fees) arising from or related to the client’s use of the images or the Photographer’s services under this agreement.
Copyright & Usage
Rokit Photography retains full copyright to all images created during the client’s session. Clients may purchase a print release with each digital file, which grants permission for personal use and printing up to the size designated on the release.
The print release does not permit publication, resale, alteration, or commercial use without written consent from Rokit Photography. Copying, scanning, downloading, printing, sharing, altering, or otherwise misusing the Photographer’s work is a violation of Federal Copyright Law.
Unauthorized use of images will result in a charge of $100 per image. Clients may share watermarked images provided by the Photographer for personal use, provided proper credit is given.
Agreement
This agreement contains the full understanding between Rokit Photography and the Client. It supersedes all prior agreements. Any changes must be made in writing and signed by all parties. If one part of this agreement is waived, all other provisions remain enforceable.
This contract constitutes an order for one session with Rokit Photography.
Final Words from Rokit Photography
I work hard to create artwork that reflects you while staying true to my creative vision. I love it when clients share their images, and I simply ask that you credit Rokit Photography by tagging or linking to my website or social media pages, rather than using screenshots or unlicensed copies.
Thank you for respecting the time, training, and dedication that go into creating your artwork. If you have questions about these terms or any part of your session, please don’t hesitate to ask.
